FAQ APOSTILLE AND LEGALIZATION

What is Apostille?

Apostille is an official certification that authenticates the origin of a public document, enabling it to be recognized in foreign countries that are parties to the Hague Apostille Convention. It serves as a simplified global standard for document verification.

What are the documents that can be apostilled?

The range of documents that can receive an Apostille is diverse, which are mainly public documents and official records. This includes birth, marriage, and death certificates; adoption papers; diplomas, degrees, and transcripts from educational institutions; court rulings; patents and trademarks; and notarial attestations.

Corporate documents such as powers of attorney, and commercial invoices, theoretically cannot be apostilled, since it is not normally considered public documents unless their issuance is attested by a notary, in which such documents become a notarial attestation—which then is eligible to be apostilled.

What is the function of Apostille?

It certifies the authenticity of the signature on a public document, the capacity in which the person signing the document has acted, and, where appropriate, the identity of the seal or stamp that the document bears. Thus, it is not confirming the content of the document, only confirming the person who is signing it.

Where to do the apostille process and how?

Apostille certificate is issued by the Ministry of Law and Human Rights, specifically the Directorate General of Legal Administrative Affairs (Direktorat Jenderal Adminstrasi Hukum Umum). The application is to be done online and can be filed by a representative.

What is a legalization process?

Similar to apostille, legalization is also an official certification that authenticates the origin of a public document to be recognized in foreign countries. Unlike apostille, legalization is applicable when the documents are to be used in a country that is not the party to the Hague Apostille Convention. The process normally can be done through the Ministry of Law and Human Rights, Ministry of Foreign Affairs, and finally the embassy of the destination country.
